Summary of Workers Compensation Benefits

Medical Care

Paid for by the employer, California Workers Compensation insurance will pay for the workers medical care that is reasonably required to cure or relieve the effects of a work related injury (or illness).  This includes doctor visits and other treatment services, tests, medicines, equipment, and travel costs reasonably necessary to treat your injury

Temporary Disability Benefits

Temporary disability benefits are payments a worker receives if they lose wages because their injury prevents them from doing their usual job while recovering.  Temporary disability pays two-thirds of the gross (pre-tax) wages the worker would lose while recovering from a job injury. Temporary disability payments begin when a doctor says the worker can’t do their usual work for more than three days or they get hospitalized overnight.

Permanent Disability Benefits

Permanent Disability is any lasting disability from a work injury or illness that affects the workers ability to earn a living.  If the workers injury or illness results in Permanent Disability, they are entitled to benefits.  Permanent Disability benefits are limited.  If the worker loses income, Permanent Disability benefits may not cover all of the income lost. If the worker experiences losses unrelated to their ability to work, Permanent Disability benefits will not cover those losses.

Supplemental Job Displacement Benefits

If the workers date of injury is in 2004 or later, they may qualify for Supplemental Job Displacement Benefits. These are vouchers to help pay for retraining or skill enhancement if they don’t recover completely from their injuries (or illness) and don’t return to work for their current employer.

Return-to-Work Supplement Program

The Return-to-Work Supplement Program (RTWSP), was created in April 2015 for the purpose of making a one-time supplemental payment to workers who experience a disproportionate loss of earnings.  A worker may be eligible for a Return-to-Work Supplement if they have a date of injury on or after January 1, 2013, and have received a Supplemental Job Displacement Benefit (SJDB) voucher for that injury.  A one-time $5,000 Return-to-Work supplement is issued to an injured worker who meets the eligibility criteria.

Death Benefits

Death benefits are payments made to a spouse, child or other dependents if an employee dies from a work-related injury or illness.  The amount of the death benefit depends on the number of total and/or partial dependents.
